Terms of Service of the Collab Analytics Application

These Terms of Service (hereinafter referred to as the "Terms") define the rules for using the internal analytics application Collab Analytics (hereinafter referred to as the "Application"), owned and administered by COLLAB SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Warsaw, at ul. Tadeusza Czackiego 15 / 17, 00-043 Warszawa, Poland, entered into the Register of Entrepreneurs of the National Court Register (KRS) under number: 0001103652, Tax Identification Number (NIP): 5253003095, National Official Register of Business Entities (REGON): 528586155 (hereinafter referred to as the "Agency").
§ 1. General Provisions and Definitions
Application – the ICT system Collab Analytics, used for the aggregation, analysis, and reporting of statistical data from social media profiles.
User (Creator) – a natural person or an individual conducting business activity who is bound to the Agency by a valid cooperation agreement (e.g., management agreement, service agreement, contract for specific work) and holds the status of a creator represented by the Agency.
Social Accounts– the User's profiles on Instagram, TikTok, Facebook (Meta), and other platforms that are subject to authorization within the Application.
Using the Application is completely free of charge and constitutes an element of technological support provided by the Agency to the Creator under the primary cooperation agreement linking the parties.
§ 2. Terms of Use and Authorization
The Application may be used exclusively by Creators holding active status as members of the Agency. The Application is not accessible to third parties or unaffiliated creators.
In order to activate the analytical functions, the Creator performs a voluntary authorization (log-in) to their Social Accounts via official data API protocols provided by the respective platforms (e.g., OAuth).
By performing the authorization, the Creator grants the Agency access to the analytical data (statistics) of their profiles.
Password Security:The Application does not retrieve, process, or store passwords to the Creator's Social Accounts. Authorization takes place securely and directly on the Meta/TikTok/external platform servers.
§ 3. Scope and Purpose of Analytical Data Processing
The Agency collects exclusively statistical and demographic data via the Application (e.g., reach, impressions, engagement metrics, audience demographics, follower counts).
This data is utilized by the Agency solely for the following purposes:
- Execution of the agreement linking the Creator and the Agency (including reporting campaign results to clients and brands).
- Creation of promotional materials and media kits for the Creator.
- Optimization of the Creator's marketing and strategic activities.
The Agency undertakes not to interfere with the integrity of the Creator's accounts. The Application operates on a "read-only" basis and is not used to publish content on behalf of the Creator, unless separate specific agreements state otherwise.
§ 4. Termination of Cooperation and Disconnection of Accounts
Access to the Application is strictly bound to the duration of the primary cooperation agreement between the Creator and the Agency.
In the event of termination, expiration, or dissolution by mutual agreement of the contract binding the Creator and the Agency, the Creator loses the right to use the Application.
Account Disconnection Procedure:
- The Creator has the right and obligation to independently "disconnect" (revoke authorization for) their Social Accounts within the Application dashboard on the final day of the agreement's validity.
- The Creator may also revoke the Application's permissions directly within the security settings of their profiles on the respective platforms (Instagram, Facebook, TikTok).
- The Agency undertakes to promptly remove the Creator's account from the Application and cease querying the API for new data upon the formal conclusion of cooperation.
Historical statistical data aggregated during the term of the agreement may be retained by the Agency solely for archival, accounting, settlement, or evidentiary purposes, in accordance with applicable legal regulations and the primary cooperation agreement.
§ 5. Personal Data Protection (GDPR)
The controller of the Creator's personal data processed within the Application is the Agency.
Detailed rules regarding the processing of personal data, including the Creator's rights to access, rectify, and request the erasure of data, are governed by the Agency's Privacy Policy and the information clause appended to the primary cooperation agreement.
§ 6. Final Provisions
In matters not regulated by these Terms, the provisions of the Civil Code, GDPR, and the primary cooperation agreement binding the Creator and the Agency shall apply.
In the event of any discrepancies between these Terms and the primary agreement (e.g., management contract), the provisions of the primary agreement shall prevail.
The Agency reserves the right to introduce amendments to these Terms for significant technical or legal reasons, of which Creators will be notified via email with a 7-day notice period.
